Terms of Service

Welcome to Ackerman & Bell. By accessing our website, engaging our services, or signing any associated agreements, you agree to be bound by the following Terms of Service.

1. Nature of Services

Ackerman & Bell provides personal assistant and lifestyle management services through a network of independent contractors (“Personal Assistants” or “PAs”). Our role is to connect clients with qualified PAs and manage scheduling, coordination, and administration.

2. Independent Contractor Relationship & Background Checks

• All PAs engaged through Ackerman & Bell are independent contractors, not employees of Ackerman & Bell. We do not control the manner in which they perform services. By hiring a PA through us, you acknowledge that the PA is acting in their own capacity as an independent service provider.
• Every PA contracted through Ackerman & Bell is required to maintain an up-to-date criminal record check and vulnerable sector background check. These checks must be current and valid prior to being placed with a client.
• While Ackerman & Bell ensures these checks are completed and kept on record, we still assume no liability for the acts, errors, or omissions of any PA.

3. Liability Waiver

By engaging Ackerman & Bell services, you expressly acknowledge and agree that:

• Ackerman & Bell shall not be liable for any damages, losses, theft, breakage, injury, accident, or claims of any kind arising from the acts, errors, or omissions of any PA.
• Any risks associated with allowing a PA into your home, office, or personal space are solely assumed by you.
• You agree to sign a Liability Waiver prior to services commencing, which releases Ackerman & Bell from any and all responsibility whatsoever.

4. Right to Refuse Service

Ackerman & Bell reserves the right, at its sole discretion, to:

• Decline to provide services to any client, either before an engagement begins or at any time during an engagement.
• Withdraw a PA from a booking if conditions are unsafe, inappropriate, or inconsistent with these Terms.

5. Payments and Booking Confirmation

• All services must be paid in full in advance before the scheduled start date.
• No booking is considered confirmed until full payment has been received.
• PAs will not begin work until all accounts are settled in full.
• Deposits may be required for certain bookings and are non-refundable.

6. Refunds and Cancellations

• Services already rendered are non-refundable.
• For bookings of 80 hours or more, clients may cancel at least 72 hours before the scheduled start date and receive a 50% refund of the booking amount.
• Bookings canceled after this time are non-refundable and will be subject to the sole discretion of Ackerman & Bell.
• Rescheduling requests are subject to PA availability and must be confirmed by Ackerman & Bell.

7. Premium Hours and Holiday Rates

Work requested outside of core hours (8:00am–6:00pm, Monday–Friday), on weekends, or during designated holidays will be billed at premium rates, as outlined in our pricing schedule.

8. Confidentiality

Ackerman & Bell respects client confidentiality. PAs are instructed to maintain discretion at all times. However, Ackerman & Bell is not liable for any breach of confidentiality by an independent contractor.

9. Indemnification

Clients agree to indemnify and hold harmless Ackerman & Bell, its owners, officers, affiliates, and contractors from any claims, damages, or legal fees arising out of use of services or the acts of any PA.

10. Governing Law

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada.

11. Acceptance of Terms

By using Ackerman & Bell services, you confirm that you have read, understood, and agree to these Terms of Service. You further acknowledge that you have signed (or will sign) the Liability Waiver, which releases Ackerman & Bell from any and all liabilities from this day forward.
